These Terms of Use (“Terms”) govern your access to and use of HistoricTourist.com, a division of LandTrad, Inc., a South Carolina corporation (“LandTrad,” “we,” “our,” or “us”). By accessing or using this platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must discontinue use immediately. These Terms apply to all visitors, users, sponsors, partners, and any other parties who interact with the platform.

1. Nature of the Platform

HistoricTourist.com is an editorial information platform published for informational, educational, and personal enjoyment purposes only. It is not a booking engine, travel agency, tour operator, or provider of professional travel, safety, legal, medical, financial, or any other licensed advisory services. Nothing on this platform constitutes professional advice of any kind. All content — including destination profiles, atlas profiles, field notes, heritage intelligence summaries, editorial commentary, visitor guidance, and any other published material — represents the opinions, experiences, research, and editorial judgment of LandTrad, Inc. and its contributors as understood at the time of publication or field visit. Publication of any content does not constitute a representation, warranty, or guarantee of accuracy, completeness, currentness, fitness for any particular purpose, or suitability for any individual user’s circumstances.

2. Accuracy, Currency, and User Verification Obligation

All content on this platform — including but not limited to atlas profiles generated through research and editorial synthesis, field-verified content derived from on-site visits, historical narratives, heritage intelligence, operational details (hours, pricing, access, contact information), and any other published information — reflects the knowledge, belief, research, and understanding of LandTrad, Inc. at the time such content was researched, visited, or written. This content may contain inaccuracies, omissions, or errors. Conditions at historic sites and destinations change continuously and without notice. Access, admission pricing, operating hours, physical conditions, ownership, management, safety conditions, and all other site-specific details are subject to change at any time without our knowledge.

You bear sole and complete responsibility for independently verifying all information presented on this platform before making any decision, taking any action, or relying on any content for any purpose whatsoever. This obligation extends to all users regardless of the purpose of their visit to the platform. LandTrad, Inc. expressly disclaims any responsibility for decisions made or actions taken based on platform content without independent user verification.

3. Assumption of Risk and Limitation of Liability

SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS PLATFORM, YOUR RELIANCE ON ANY PLATFORM CONTENT, YOUR VISIT TO ANY DESTINATION OR SITE REFERENCED ON THE PLATFORM, OR ANY OUTCOME RESULTING THEREFROM.

This limitation applies regardless of the theory of liability — whether in contract, tort, negligence, strict liability, or otherwise — and regardless of whether LandTrad, Inc. has been advised of the possibility of such damages. LandTrad’s total cumulative liability to you for any claims arising from use of this platform shall not exceed one hundred US dollars ($100.00). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

THIS PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LANDTRAD, INC. EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INCLUDING ATLAS PROFILES, FIELD NOTES, HERITAGE INTELLIGENCE, OR OPERATIONAL INFORMATION.

Historic sites, destinations, and properties referenced on this platform are owned and operated by third parties over whom LandTrad, Inc. has no control. We make no representations regarding the condition, safety, accessibility, or suitability of any destination. Visiting any destination referenced on this platform is done entirely at your own risk.

5. Indemnification

You agree to indemnify, defend, and hold harmless LandTrad, Inc., its officers, directors, employees, agents, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to: (a) your use of or access to this platform; (b) your reliance on any platform content; (c) your visit to any destination referenced on the platform; (d) your violation of these Terms; (e) your violation of any applicable law or regulation; or (f) any claim by a third party arising from your conduct in connection with the platform.

6. Intellectual Property

All content on this platform — including editorial text, atlas profiles, field notes, heritage intelligence, photography, video content produced under the Oak Sterling and Preservation Lens brands, illustrations, maps, design elements, data compilations, and all other original works — is the exclusive property of LandTrad, Inc. or its licensed contributors and is protected by United States and international copyright, trademark, and intellectual property laws.

You may access and view platform content for personal, non-commercial use only. You may not reproduce, republish, distribute, transmit, sell, license, modify, create derivative works from, or use any platform content for any commercial purpose or in any manner that competes with or substitutes for this platform without prior written permission from LandTrad, Inc. Systematic scraping, harvesting, or extraction of platform content — including for the purpose of training artificial intelligence or machine learning systems — is expressly prohibited.

7. Sponsorships and Partnerships

Sponsorships, partnerships, and listing arrangements on this platform are commercial relationships governed by separate written agreements between LandTrad, Inc. and the respective partner or sponsor. All fees associated with sponsorships, partnerships, and listings are non-refundable under all circumstances without exception. LandTrad, Inc.’s obligation to sponsors and partners is limited solely to publication of their listings and content in accordance with the conventions and formats displayed on the platform. We make no representations regarding the performance, reach, or commercial outcome of any sponsorship or partnership placement. LandTrad, Inc. is not responsible for any business outcomes, decisions, or results arising from a sponsor’s or partner’s participation on the platform.

8. Third-Party Content and Links

This platform may reference, link to, or incorporate information sourced from third parties including historic sites, preservation organizations, government agencies, academic institutions, and other sources. Such references are provided for informational context only. LandTrad, Inc. does not endorse, control, or assume responsibility for the accuracy, completeness, or reliability of any third-party content. Any reliance on third-party information is at your own risk.

9. International Use

This platform is operated from the United States. LandTrad, Inc. makes no representation that content or services are appropriate or available for use in any particular location outside the United States. Users who access this platform from outside the United States do so on their own initiative and are solely responsible for compliance with all applicable local laws and regulations. LandTrad, Inc. makes no warranty that this platform complies with the laws of any jurisdiction other than the United States.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law provisions. Any dispute arising from or related to these Terms or your use of this platform shall be resolved exclusively in the state or federal courts located in South Carolina, and you irrevocably consent to the personal jurisdiction of such courts. Any claim arising from use of this platform must be brought within one (1) year of the date the claim arose, after which such claim is permanently barred.

11. Changes to These Terms

LandTrad, Inc. reserves the right to modify these Terms at any time without prior notice. Changes are effective immediately upon posting. Your continued use of the platform following any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
